Payroll tax is the percentage amount retained from an employee's salary and paid to the government to invest in the welfare of the general population.

Overtime

Under Haitian labor law, overtime is typically paid at a premium rate of 150% of the employee's regular hourly wage. This means that for every hour of overtime worked, the employee receives a 50% pay increase. These hours may not exceed 80 hours per quarter.

Haiti does not currently have a comprehensive data protection law in place. However, there are a number of sectoral laws that govern the retention of personal data. These include:

Hiring and Onboarding Requirements

Hiring

Haiti's labor code prohibits discrimination in hiring based on race, color, sex, origin, religion, opinion, social status, or physical or mental disability. However, there is no legal requirement for employers to give preferential treatment to certain groups of people in the hiring process.

Annual leave

Permanent workers, following one year of service, are entitled to a paid leave lasting a minimum of 15 consecutive days. This includes 13 working days and 2 Sundays.

Sick leave

Workers are entitled to 15 days of sick leave per year without a reduction in salary. To avail this benefit, the worker must provide a medical certificate from either a company doctor or the Public Health Service.

Paternity leave

No statutory laws on paternity leave.

Maternity leave

Maternity leave is a paid leave of absence with a total duration of 12 weeks. During this period, the employer covers payment for 6 weeks. The leave spans six weeks before childbirth and six weeks after confinement, ensuring a balance in pre and post-natal care.and other 

A portion of the maternity leave, particularly after childbirth, will be covered by the Workplace Accident, Sickness, and Maternity Insurance Office (OFATMA).

Adoption / Miscarriage or premature birth leave:

In the case of abortion or premature birth of a non-viable child, the worker is entitled to a leave ranging from two to four weeks, during which she will receive payment based on the salary she received at the commencement of the leave. If the child is viable, the regulations pertaining to maternity leave will be applicable.

Termination

Overview

According to the Haitian Labor Law, termination notices are required for workers with over three months of service, and notice periods vary by the duration of employment.

Notice Period

The notice period is determined based on the length of employment as follows:

  1. 15 days notice for an employment period of 3 to 12 months. 
  2. 1-month notice for an employment period of 1 to 3 years. 
  3. 2-month notice for an employment period of 3 to 6 years. 
  4. 3-month notice for an employment period of 6 to 10 years.

Severance Pay

Severance pay is not mandatory in Haiti as per the law. However, employers are required to provide notice pay to employees who are terminated without cause.
