Payroll Taxes
Payroll tax is the percentage amount retained from an employee's salary and paid to the government to invest in the welfare of the general population.
Employee Taxes
Social Security Contribution: 5%
Divided as follows:
- Medical expenses and disability: 2.5%
- Old age pensions and death benefits: 2.5%
Employee Income Tax:
- Individuals resident in Guinea are subject to tax on worldwide income.
- Nonresidents are subject to tax on Guinea source income only.
- Guinea follows a personal income tax rate of 40%.

Overtime
In Guinea, the regular working day is 8 hours, and the standard workweek is 40 hours. Overtime hours may not exceed 10 per day or 48 per week. Additionally, overtime is limited to 100 hours per calendar year, unless the labor inspector grants special authorization.
Overtime work during the first four hours in a week is compensated at 130% of the regular hourly rate. Overtime exceeding four hours in a week is compensated at a higher rate of 160% of the regular hourly rate.

Hiring of employees
Guinean formal anti-discrimination laws may be limited, hiring practices can sometimes reflect broader social and cultural preferences. For example, local preference might be given to Guinean nationals over foreigners, and there might be a tendency to favor candidates from certain regions or ethnic groups.
Guinea's labor laws do not explicitly provide comprehensive anti-discrimination protections. However, general principles of non-discrimination are embedded in the Constitution and labor regulations, which prohibit discrimination based on race, sex, religion, and other personal characteristics.

In Guinea, the following leave policies are applicable to employees:
Annual Leave
The Labor Code of Guinea specifies that each worker is entitled to paid leave at the rate of two and a half working days per month of actual work. Employees become eligible for annual leave after completing one month of service. The maximum duration for paid leave is limited to 12 consecutive working days.
Maternity Leave
In Guinea, female employees are entitled to maternity leave starting six weeks before the expected delivery and continuing for eight weeks after childbirth. Leave can be extended for medical conditions up to eight weeks before delivery and ten weeks after. For multiple births, leave is extended by two weeks. During this period, the employer pays half of the salary, and the National Social Security Fund pays the other half.
Sick Leave
Employees are generally entitled to up to 26 weeks of paid sick leave.
Termination
Employers can terminate employees for "personal reasons" such as :
- Ineptitude
- Ill health
- Misconduct.
The employer must give the employee at least 5 days' notice for an interview via a registered letter, stating the reasons for the proposed dismissal. After the interview, the employer must wait 2 days before proceeding with the dismissal, which must then be communicated by hand-delivered letter within three days of the interview.
For staff reductions due to economic reasons, the employer must involve the trade union.
Notice Period
The notice period depends on the role of the employee:
- For operational staff, it is 2 weeks notice
- For supervisors, it is 1 month notice
- For middle managers and above, it is 3 months notice
Severance Pay
According to Article 50 of the Collective Agreement, severance pay is not granted when a worker is dismissed for gross misconduct. For individual dismissals, severance pay rates are:
- 33% of the average monthly salary for each completed year of the first five years
- 35% of the average monthly salary per year from the 6th to 10th year inclusive
- 40% of the average monthly salary per year beyond the 10th year
Visa
Overview
To work long-term in Guinea, employees need a Long-Term Visa. This visa is granted only after the foreign national has obtained an entry visa and lived in Guinea for 90 days. Applicants must also provide employment contracts approved by the relevant authorities.
- The documents you need when you apply for a Guinea visa are:
- The passport of the applicant, which is valid for six months or more
- Scanned copies of the passport’s information page
- A passport-size picture of the applicant with a white background
- A Yellow Fever Certificate
- A confirmed return-flight booked ticket
- If applying for a diplomatic/service/courtesy visa: An official Letter of Nomination or
- Appointment
- Additional documents will be required based on the purpose of the trip.
